For Hire and Tuition Bookings, Shop and Online Purchases
Acceptance of your booking / order
- Please note that completion of the online checkout process does not constitute our acceptance of your order. You will receive an order confirmation by email from Derwent Water Marina once we have received payment in full.
Tuition Booking
- Full payment in advance
- Bookings are non-refundable once made.e
- If the minimum number of participates is not met, we reserve the right to cancel, offer an alternative date or run as a private session (addition cost of this).
- If we cancel the session all monies will be refunded.
- Health declaration forms must be completed and returned before attending the session.
- All bookings are accepted on the basis that the customer will, at all times, observe the safety rules/regulations set by Derwent Water Marina.
Hire Booking
- I have read and agree to the Conditions of Hire.
- Bookings may be cancelled or amended up to 7 days prior to your booking date after that no money will be refunded.
- Pre-booked hire cannot be moved to another date.
- Parking is only available for the duration of your hire & the gate will be locked at 17.30 or 18.00.
- We do not offer facilities to launch your own craft.
- You must not exceed the maximum load capacity of the craft hired.
Shop Purchase
Product descriptions
We have taken reasonable precautions to try to that all products have been fairly described. However, when ordering products or services through the Website, please note that:- All prices are displayed in pounds Sterling inclusive of UK VAT.
- Packaging may vary from that shown on the Website.
- The weights, dimensions and capacities shown on the Website are approximate only.
- Whilst we try to display the colours of our products accurately on the Website, the actual colours you see will depend on your monitor and we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery.
Stock levels
- We use a stock levels indicator on our online shop.
- We will endeavour to ensure these are correct but now and then there may be errors.
- We will contact you as soon as your order is placed if your item is out of stock.
Collection Only
- Items purchased online through our website are Collection only.
- Once your order has been confirmed and payment received you will need to contact us to arrange a suitable time to collect your purchase.
PRIVACY
- We will collect and store your information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy Policy.
- Any Personal information requested by Derwent Water Marina is held in its original form and is used to help Marina staff to deliver courses it is not used for Marketing or supplied to any third parties.
- Under GDPR, we must always have a lawful basis for using your personal data. This may be because the data is necessary for our performance of a contract with you, because you have consented to our use of your personal data, or because it is in our legitimate business interests to use it.
LIABILITY
- There are certain liabilities which we cannot exclude by law and nothing in these Terms and Conditions limits our liability for personal injury or death caused by our negligence or for fraud.
- You have certain rights as a consumer, including legal rights relating to faulty or misdescribed goods.
- For further information about your legal rights in the UK, contact your local authority Trading Standards Department or Citizen’s Advice Bureau.
- Nothing in these Terms and Conditions will affect these legal rights and we will perform our obligations under these Terms and Conditions with reasonable care and skill.
- Any products we supply to you will be of satisfactory quality.
- We are only responsible for losses that are a natural, foreseeable consequence of our breach of these Terms and Conditions. We will not be liable to you if we are, prevented or delayed from complying with our obligations under these Terms and Conditions by anything you (or anyone acting on your behalf) does or fails to do, or due to events which are beyond our reasonable control.
- You must follow any advice we give you to keep products we supply to you safe (including any instructions or product manuals provided with the products). We cannot accept liability for damage to products we have supplied caused by your failure to follow this advice.
- In any event we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues, or business interruption.
